1. Who you are contracting with

The Sing or Fling service at singorfling.com is provided by Singorfling.com ("we", "us"). By creating an account or continuing to use the service, you agree to these terms. If you are using the service for an organisation, you confirm you have authority to bind it. If you are using it as an individual, you confirm you are at least 16 years old.

2. What the service is

Sing or Fling is a lighthearted live karaoke arena. Users choose a role: Singers join a queue and get a timed live performance slot broadcast from their own camera and microphone; Flingers watch and react. Reactions are either free "Love" or paid "Fling" actions using free virtual fruit. Everyone who takes the stage opts in knowing they may be flung at.

3. Your account

Provide accurate information and keep it up to date. You are responsible for keeping your credentials confidential and for all activity under your account. Tell us immediately if you suspect unauthorised access.

4. Acceptable use

You must not:

• use the service unlawfully, or for fraud, spam, or harassment;
• broadcast or upload content that is illegal, sexually explicit, hateful, violent, or that harasses, threatens, or targets any person or group;
• broadcast content you do not have the rights to, or infringe anyone's intellectual property;
• interfere with the security or integrity of the service — no malware, probing, scraping, reverse engineering, or circumventing technical limits;
• resell, redistribute, or commercially exploit the service or virtual fruit.

Cheeky is the point; cruelty is not. We may remove content, end a performance slot, or restrict an account at our discretion to enforce this section.

5. Your content and live performances

You keep ownership of what you perform and post. You grant us a limited, non-exclusive licence to host, transmit, and display it solely to operate the service — including relaying your live feed to viewers in your room. We do not record performances. If you believe content on the service infringes your rights, email support@singorfling.com and we will investigate and remove infringing content; repeat infringers lose their accounts.

6. Fruit baskets

Fruit baskets are virtual items with no cash value, usable only inside Sing or Fling. Sending Love and flinging fruit are both free — Sing or Fling does not sell anything and takes no payments.

7. Availability

We do our best to keep the arena open, but we do not guarantee uninterrupted or error-free performance. Live peer-to-peer streaming quality depends on your network and device. We may change, suspend, or discontinue features.

8. Our intellectual property

We own the service and everything in it other than user content — software, design, branding, and documentation. You get a limited, non-exclusive, non-transferable right to use the service.

9. Suspension and termination

We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the service at any time. On termination, unused virtual fruit is forfeited except where a refund is owed under our Refund Policy or applicable law.

10. Warranties and liability

To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential, or special damages, including lost profits, data, or goodwill. Our total aggregate liability is limited to the amounts you paid us in the 12 months before the claim. Nothing here excludes liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded by law.

11. Indemnity

You will indemnify us against claims arising from your content, your use of the service, or your breach of these terms.

12. General

You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control. These terms are governed by the laws of the seller's jurisdiction, and disputes will be heard by its courts. We may update these terms and will announce material changes in the app or by email.
